Membership Agreement

This Membership Agreement ("Agreement") is entered into between {name} ("Member") and The Dance Spot UK - Clacton-on-Sea ("Company"). By signing this Agreement, the Member agrees to the following terms and conditions:

1. Membership Term and Payments 1.1 The Member agrees to a minimum commitment period of three (3) months, during which they will pay a monthly fee at the rate selected upon signup. 1.2 After the initial 3-month period, the membership will continue on a rolling monthly basis unless canceled by the Member in accordance with Section 2. 1.3 Payments are due on the agreed date each month. If a payment is late by five (5) days, a late fee of 10% of the monthly membership cost will be applied.

2. Cancellation and Fees 2.1 The Member may cancel their membership at any time; however, if canceled before the end of the 3-month minimum term, the full remaining balance for the term must be paid. 2.2 If the membership is canceled after the initial 3-month term, a cancellation fee equal to 50% of the monthly membership cost will be charged. 2.3 Cancellations must be submitted in writing to the Company or via the Member Portal.

3. Member Responsibilities 3.1 The Member agrees to abide by all policies and rules set by the Company. 3.2 The Member is responsible for updating their payment details, contact information, and emergency contact details as necessary. 3.3 The Member agrees that failure to comply with payment obligations may result in the suspension or termination of their membership.

4. Liability and Waiver 4.1 The Member acknowledges that participation in any activities at the Company’s facilities is voluntary and assumes all risks associated with participation. 4.2 The Member releases the Company from any liability for personal injury, loss, or damage incurred while using the facilities or services.

Terms and Conditions for The Dance Spot Membership Schemes

1. What These Terms Cover: These terms and conditions govern your membership at The Dance Spot. Please read them carefully before submitting your membership application. They outline who we are, how we will provide services to you, how you and we may change or end the contract, what to do if there is a problem, and other important information.

2. Information About Us and How to Contact Us:

   Who We Are: We are The Dance Spot, a dance school dedicated to providing quality dance education and training.

   How We May Contact You: If we need to contact you, we will do so by telephone, text message, or in writing at the email address provided in your membership application. "Writing" includes emails.

3. Your Membership: Your membership is personal to you and cannot be transferred without our prior written consent. If you wish to transfer your membership permanently, you must submit a written request. Any proposed replacement member must provide the same information you submitted upon joining, agree to these terms, and undergo an assessment. If approved, an administrative fee will apply.

4. Membership Start and Duration: Your membership starts today and will run until you request to cancel.

   Memberships are billed monthly.

   If you wish to change your start date, you may submit a written request. While there is no charge for this service, changing your start date may result in an adjustment to your next payment.

5. Code of Conduct and Member Responsibilities: Members are responsible for maintaining, paying for, and cancelling their memberships. The Dance Spot is not responsible for cancelling memberships except in exceptional circumstances.

   In the event of a temporary closure, we will pause all memberships, including payments, for the duration of the closure. Memberships will automatically resume once The Dance Spot reopens.

   Members and their guests must adhere to the rules of conduct while on the premises, which include:

   • Dressing appropriately for activities.

   • Showing consideration for others.

   • Refraining from inappropriate, abusive, or offensive language or behaviour.

   • Not being under the influence of illegal drugs.

   • Avoiding any antisocial or disruptive behaviour.

6. Financial Terms: If a payment is declined or pending, a holding fee for the current class may be required. This fee will be refunded via the original payment method or offered as a voucher valid for one month.

   If you pay by direct debit and a payment fails, an administrative fee will be charged for each missed payment.

   We may increase membership fees at any time with at least 30 days' written notice. If you do not wish to pay the higher fee, you may cancel your membership before the increase takes effect. Until your cancellation is processed, you will continue to be charged at the previous rate.

7. Sibling Discount: We offer a sibling discount that can be applied to your membership. Information on the current discount is available in the members' portal. This discount is offered as an additional perk and is not part of this contractual agreement. As such, it may be modified or revoked at any time at our discretion.

8. Our Rights to End the Contract: We may terminate your membership immediately if:

   • You commit a serious breach of these terms, including conduct violations.

   • You fail to make a required payment within 7 days of a missed payment notice.

   • Your membership was previously revoked, or you joined without prior consent while in dispute with us.

   • We believe your continued membership poses a risk to others or to The Dance Spot’s reputation.

9. Liability: The Dance Spot is not liable for injuries, damages, or losses incurred during participation in activities. Members join at their own risk.

   We are not responsible for lost, damaged, or stolen valuables on the premises, including items in lockers.

10. Privacy Policy: We are committed to protecting your privacy. Our privacy policy, detailing how we handle your personal information, is available on our website under the "Policies" section.

11. Text Messaging Service: By providing your phone number, you consent to receive text messages from The Dance Spot related to your membership, class schedules, promotions, and important updates.

    • Opt-In: You may opt-in to receive text messages by selecting the option during membership registration or by updating your preferences in the Member Portal.

    • Opt-Out: You may opt-out of receiving text messages at any time by replying "STOP" to any message received or by updating your preferences in the Member Portal.

12. Other Important Terms:

    • We are not responsible for events beyond our control.

    • We may transfer our rights and obligations under these terms to another organization with similar standing.

    • These terms are governed by English law, and legal proceedings may be brought in English courts or in the courts of Scotland or Northern Ireland, depending on your residence.

13. Acknowledgment and Acceptance: By signing below, you confirm that you have read, understood, and agreed to the terms outlined in this document. This is done on the website.

Photo Consent Declaration

As part of our commitment to celebrating the experiences and achievements of everyone at The Dance Spot, we may capture photographs and digital images during dance classes, performances, and related activities. These images may be used for promotional materials, teaching aids, and case studies.

   • These images may appear on our official website, social media pages, marketing materials, and other relevant platforms.

   • My full name may be published externally alongside my photographs unless I request otherwise in writing.

   Privacy and Safety:

   • The Dance Spot is committed to protecting your privacy. Images will not be shared with third parties for marketing purposes.

   • We may refer to participants by their full name in external publications.

   Storage and Duration:

   • Images will be stored securely on our equipment and accessible only by authorised staff.

   • We retain images for up to 10 years following your involvement with The Dance Spot.

3. Consent Confirmation (Mandatory)

   I agree to the terms outlined above and give permission for The Dance Spot to use {name} likeness and photos as described. By confirming, you acknowledge that you have read and understood the terms of this consent agreement. You also grant permission for The Dance Spot to use the images and case study material.

Physical Touch Consent Declaration

Welcome to The Dance Spot! We are excited to have you join our Street Dance classes. To ensure a safe and comfortable learning environment, please review and acknowledge the following points regarding instructor-student interaction during sessions.

1. Attendee Information

2. Parental Consent (if applicable)

   By signing this form, parents or guardians consent to instructors or staff of The Dance Spot interacting physically with their child when necessary for teaching and ensuring the safe execution of dance movements. While this general consent is granted, instructors will always ask for the student's individual consent before any physical adjustments are made.

3. Instructor-Student Interaction

   • During the class, instructors may need to adjust a student’s position to ensure proper technique and safety.

   • This will first be demonstrated verbally or visually. If additional adjustment is required, the instructor will ask, "Can I touch you?" before proceeding.

   • If permission is granted, the instructor will apply the necessary physical adjustment, relevant to the move being taught.

   • This permission remains valid for the duration of the class but can be withdrawn at any time.

4. Safety Measures

   • For certain movements, including tricks, physical contact may involve additional force to support, assist, or restrict movement to prevent injury.

   • Restrictive contact will only occur if the student’s safety is at risk, and every effort will be made to prioritise safety at all times.

5. Revoking Permission

   • A student may withdraw consent at any time by stating they no longer wish to be touched.

   • If more than 10 minutes remain in the class, they will be asked once more if necessary. If they decline again, no further physical contact will take place.

6. Signs of Discomfort

   • If an instructor notices signs of discomfort despite prior consent, they will seek reaffirmation.

   • If discomfort continues after a second confirmation, physical contact will cease, and this will be discussed with the parent or guardian where applicable.

7. Locations of Touch

   • Instructors will avoid touching students between the mid-thigh and hip, and in the chest area for female-identifying students, without express permission.

   • If necessary, instructors will specify, "Can I touch you on the…" and demonstrate the area on themselves before proceeding.

   • Permission for specific areas lasts only for the duration of the trick being taught and expires at the end of the session.

8. Concerns and Issues

   If you have any concerns regarding physical contact during classes, please contact our safeguarding officer at safeguarding@thedancespot.uk.

9. Consent Confirmation (Mandatory)
